Officer's Report
The Site
The site represents the residential curtilage of an existing dwelling which is situated to the east of Ballacriy Park. The property is a substantial dwelling which sits in a sizeable plot.
Planning Status
The site lies within an area designated as Open Space and of High Landscape Value and Scenic or Coastal Significance on the Arbory and East Rushen Local Plan of 1999.
Planning History
The site has been the subject of a number of applications:
- PA 88/1141 – reconstruction of existing driveway for vehicular use – permitted
- PA 93/0473 – alterations and provision of additional living accommodation – refused initially and permitted on review
- PA 94/1222 – refurbishment and excavation of ponds – refused initially and permitted on review
- PA 95/0410 – approval in principle to demolish and rebuild the western side of the house – permitted
- PA 95/0980 – alterations and extensions to rear of property – permitted on review
- PA 96/0667 – re-construction of existing driveway – refused initially and refused on review
- PA 97/1306 – raising of roof and installation of additional windows and doors – permitted
- PA 01/1475 – demolition and re-building of part of dwelling – permitted
PA 01/1117 – approval in principle for restoration of former dwelling to create tourist accommodation – refused on appeal PA 05/1795 – amendments to approved extension and rebuilt area of dwelling – permitted
The Proposal
Proposed now are alterations to the windows. The approved scheme shows a single large window above the front porch which is a simple double door – proposed is the omission of the large window and installation of two vertically proportioned windows with pillastered porch below.
Representations
Arbory Parish Commissioners indicate that they have no objections to the application.
Assessment
The proposal has only a limited impact as the property is so far from the regularly used public highway. In any case, the two windows are more in keeping with the remainder of the house and the porch is sympathetic to the size and character of the dwelling.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the alterations to windows and porch as shown in drawings AT 416.2 Rev 1, 416.1 Rev 1 and the site and location plans and plans as approved, all received on 15th May, 2008.
