Officer's Report
The Site
The application site represents the curtilage of Edelweiss, Glenlough Circle, Glen Vine, Marown. The property is a single storey bungalow situated towards the top of the cul-de-sac.
Planning Status
The application site is located within an area identified as being Predominantly Residential use by the 1982 Development Order.
Planning History
There are no previous planning applications considered relevant in the assessment and determination of this application.
Representations
Marown Parish Commissioners do not object to this application.
The Department of Transport Highways Division does not oppose this application.
The owner/occupier of Granane, Glenlough Circle, Marown objects to this application. Their reasons for objecting may be summarised as concerns that the car port is attached to their property, drainage and risk of fire.
The Proposal
This application seeks retrospective approval for the conversion of what was an open car port to an enclosed shed located between the proposal site and the adjacent property, Granane. The foot print of the flat roof structure has remained the same with the main alteration being the addition of doors and walls to enclose the structure.
Assessment
The shed is considered to have little impact upon the street scene, indeed the addition of doors to the structure acts to screen any items being stored within the shed.
The concerns raised by the neighbouring objector are understood, however private property rights are not a material planning consideration and as such any dispute regarding the fixing of the shed to the adjacent property wall is a civil matter to be reconciled between the applicant and the neighbour. Property values are also not material to the determination of a planning application.
It is considered that there are no adverse impacts upon neighbouring properties or the surrounding area in general so as to warrant refusal of this application. It is however noted that there is a window in the south elevation of the shed which looks onto the garden of Granane. Whilst the shed is not a habitable room, it is considered that this should be fitted with obscure glazing to prevent any perception of overlooking.
Recommendation
It is recommended that the application be approved.
