I therefore assume that provision on this particular site is not an issue. Consultee : Manx Electricity Authority Notes: There are Underground Cables/Overhead Lines present in the area indicated in you Planning Application. Please contact our Network Operations Department, Manx Electricity Authority, (Tel. 687687) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site. Contact the M.E.A. for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 \& GS6.
The application is proposing to reduce the number of apartments from 72 to 54 . A previously approved electricity substation within the building is also removed and replaced with residential accommodation. The application is also proposing a number of minor external alterations, which do not impact on the visual amenities of the locality or the integrity of the development.
Mr Jessopp does not object to the proposal provided the number of affordable units that are to be built meet the requirement of Housing Policy 5 [and] remains at 18; however, the proposed development has been scaled down to 54 unit and therefore the number of affordable units will need to be revised to 14 units.
Furthermore, the decision notice for PA 05/01706/8 stated that "The Department has concluded that the provision of affordable units arising from this development ( 18 units) should be made not on this site but on the contiguous land to the west; such provision will be in addition to that arising from the development proposed on that land."
It is recommend that a similar note be attached to this new planning permission but with the revised number of units.
The Highways Division of the Department of Transport do not object to the proposal subject to a condition that the numbers of parking spaces are to be retained. A condition on the original permission required that the parking should be retained. This application does not seek to amend the car parking layout. A condition requiring the parking to be laid out in accordance with the original permission be recommended.
The notes suggested by consultees are not material planning considerations and for that reason are not attached to the report, as part of the recommendation.
It is recommended that planning permission be granted subject to conditions.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The comments from the Manx Electricity Authority and Isle of Man Fire and Rescue Service are not a material consideration and should not be afforded party status in this instance.
Estates and Housing Directorate are part of the Department of Local Government and the Environment and should not be afforded separate party status in this instance.
Mr Jessop of Seacliffe, Old Castletown Road, Port Soderick, given his distance from the application site should not be granted Interested Party Status under the provisions of Planning Circular 1/06.
In summary, it is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded interested party status:
Highways Division of the Department of Transport Accordingly the following parties are not afforded interested party status: Manx Electricity Authority Isle of Man Fire and Rescue Service Estates and Housing Directorate of the Department of Local Government and the Environment. C 1. This permission relates to the erection of a new building containing 54 apartments, 2 commercial units and basement parking as shown in drawing numbers A PL300, A PL318, A PL343, A PL344, APL345, A PL346, A PL347, A PL348, ae01 Rev a, ae02 Rev b, ae05 Rev b, as05 Rev a date stamped 22nd May 2008.
C 2. The proposed commerical units may be used for any purposes within Class 3 ("Food and Drink") of Schedule 4 to the Town and Country Planning (Permitted Development) Order 2005; an other use must form the subject of a separate planning application.
C 3. Any external changes (including the provision of signage) arising from the specific use of the commerical units must form the subject of a further separate applications.
C 4. The construction works must be undertaken in accordance with the "Method Statement" approved as part of Planning Permission 05/01706/Band date stamped 9th September 2005; during the works, the structural condition and stability of the existing river wall must be monitored by the developer in accordance with the Recommendations contained within the "Structural Report on (the) wall" approved as part of of Planning Permission 05/01706/B and date stamped 15th September 2005.
C 5. Prior to the occupation of any of the proposed flats: a) the amended cycleway/walkway, as approved under condition 5 of Planning Permission 05/0106/B on the 25th July 2007, must be completed; and b) Arrangements for the future maintenance of the cycleway/walkway must be concluded, and detail thereof submitted to and approved by the planning authority.

The proposed parking spaces indicated on the plans approved as part of Planning Permission 05/01706/B must be available for use prior to occupation of any of the flats, and thereafter must be retained and be available for parking by residents (and their visitors) of the flats only; there must be provided a minimum of four spaces suitable, in terms of dimensions and location, for use by disabled drivers.
C 7. Prior to the occupation of the proposed flats, the arrangements for the storage and collection of refuse must be submitted to and approved in writing by the planning authority.
Note: You are advised to consult Douglas Corporation with regard to the detail prior to submitted them to the planning authority.
N 1. The Department has concluded that the provision of affordable units arising from this development (14 units) should be made not on this site but on the contiguous land to the west; such provision will be in addition to that arising from the development proposed on that land.
