The site represents the domestic curtilage of an existing dwelling which is situated on the northern side of Fistard Road as it turns up from its junction with Clifton Road, from Port St. Mary. The existing dwelling has a roughly square footprint with a small rear lean-to annex for a boiler house on the rear. The property has a garage in the rear garden, which is accessed from the rear.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 and the draft Port St. Mary Area Plan as Residential.
Planning permission was sought and granted on appeal for alterations and the erection of the rear garage under PA 91/1569. Permission was then sought and granted for the demolition of existing garage and erection of a new one (PA 96/1574) and for a first floor extension (PA 02/0302).
Proposed now is a first floor extension which is smaller in size than the approved extension in that the existing boiler room annex is not to be extended upward in this latest proposal. The upward extension of the main dwelling will, however be the same height and massing but the first floor front bay windows are not to be included. The initial approval is still valid as it was extended up until 1st July, 2008.
Department of Transport Highways and Traffic Division raise no objection to the application. Port St. Mary Commissioners do not object to the application but express concern that a number of applications have been submitted for the property and have not been implemented.
The Isle of Man Fire and Rescue Service recommend consultation regarding the internal layout.
The proposal is remarkably similar to that which has had approval and which can still be implemented. There has been no change in policy since that decision and as such, the general size and form of the extension should still be considered acceptable.
The property sits between a bungalow of similar proportions to the existing, and a pair of two storey houses. The proposed dwelling will sit comfortably between the two and is acceptable. Whilst the submission of a number of applications for the same or similar developments which are then not implemented, can be frustrating for those who have to comment on them, but there is no legal or procedural restriction on this.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The Fire Prevention Officer comments on the internal layout which is dealt with as part of the Building Regulations and as such is not a planning matter. The Fire Prevention Officer should not be afforded party status in this instance.

C 2. This permission relates to the alterations and extensions shown in drawings 08/20/01 and -02 both received on 10th March, 2008.
N 1. PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.
