The Site
The site represents the residential curtilage of an existing property which sits within Hawthorn Grove - a cul de sac within Silverburn estate and backs onto the steam railway line. The property is a detached bungalow.
Planning Status
The site lies within an area designated as Residential on the Isle of Man Planning Scheme (Development Plan) Order 1982.
Planning History
Two applications have been submitted previously in respect of this site: PA 89/1687 - construction of a door and alterations to create a patio door and window - permitted PA 93/0027 - alterations and extension - permitted
The Proposal
Now proposed is the erection of a conservatory on the rear elevation. The footprint is 4.2 m by 3.1 , and the height to the ridge is 3.1 m . The site plan shows the footprint being slightly smaller than the dimensions suggest but there will still be some 4 m from the boundary with the steam railway line. The property at number 103 extends right up to the railway line and was approved on appeal (PA 92/0756).
Representations
Malew Parish Commissioners indicate that they have no objections to the proposal. Department of Transport Drainage Division recommend conditions regarding the drainage of the site.
Assessment
The conservatory is unlikely to be visible by anyone other than the applicants or those passing on the railway line and in any case is not an unattractive structure on a modern property.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

This permission relates to the erection of a conservatory as shown in the drawings and plans received on 12th February, 2008.
