Re: Pa 08/00332/B Upper Kirkill Farm, Colby
Please accept this letter from Callow's Yard Developments Limited acting as Agent on behalf of Mr & Mrs A J Corlett (occupant and immanent purchaser) and Mr & Mrs R Tilleard (owners) of Kirkle Farm, as acknowledgement to the proposed works as indicated within Planning Application No. 08/00332/B. We would also note that this is the third application in respect to the above property, the first of which we had no objection to (which was however refused by yourselves) and the second of which we have objected to and is still to be determined.
It is accepted that any redevelopment will cause a certain amount of disruption and disruption per se is not a valid ground for refusing planning approval. However, having regard to the particular area, it is to be noted that the access to the site would be via the lane to and owned by Kirkle Farm.
This lane is in private ownership and although the applicant has a limited right of access, ordinarily the right of access would not extend to construction traffic and the lane in its present format is clearly unsuitable and in many places impassable for construction traffic such as delivery lorries, JCBs, cranes and the like.
Furthermore, in order to protect the privacy of the lane which has been the subject of unauthorised trial bike and quad bike activity of late, including a police documented security issue, a system of gates has been installed to protect the privacy of all lane users but will not ordinarily afford access to vehicular traffic.

We will not be objecting to the replacement of the existing stables per se, however the above matters must be considered in your overall consideration of any proposed building works at Upper Kirkill that directly effect Kirkle Farm.
