The application sought permission to erect a replacement dwelling on the curtilage of an existing four-bedroom, two-bathroom traditional cottage situated to the west of the Sloc (A36) in Arbory. The property, accessed via a private lane, had been extended on both sides — a two-storey addition to the south and a single-storey garage to the north — and sits within an Area of High Landscape or Coastal Value and Scenic Significance. The key planning question was whether the replacement was justified under Housing Policy 12 of the Strategic Plan, which permits replacement dwellings in the countryside where the property has not been abandoned. The cottage, while attractive, showed evidence of unsympathetic alterations including enlarged ground-floor windows, misaligned upper-floor windows in the extension, and modern garage doors — factors that weighed against treating it as a building of sufficient architectural or historic merit to require retention. The Planning Committee approved the application, with five conditions attached including a restriction on further permitted development.
The Planning Committee approved the application because the existing dwelling retained its habitable status, satisfying the key test under Housing Policy 12 for countryside replacement dwellings.
Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Condition 2
This permission relates to the erection of a replacement dwelling as shown in drawings 207-01a and 270-04a received on 2nd April, 2008 and the location plan received on 22nd January, 2008.
Condition 3
All exterior walling must be finished in natural Manx stone, traditionally laid.
Condition 4
All roofing must be in dark natural slate.
Condition 5
Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2005 (or any Order revoking or re-enacting that Order) no extensions, greenhouses, walls, gates, fences, garden sheds, summerhouses, flag poles, decking, garages, or tanks for the storage of oil for domestic heating shall be erected (other than those expressly authorised by this approval.)
