TO: Partington Nixon & Kinrade, 7-9 Drinkwater Street, Douglas, ISLE OF MAN, IM1 1AT.

In pursuance of his powers under the above Act and Order, the MINISTER for Local Government and the Environment, following report by the appointed person, does hereby APPROVE the application by Mr S O'Connell – Additional use of ground floor shop as a café, 35 North Quay, Douglas, IM1 4LB, subject to compliance with the following conditions:-
- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- This permission relates to the additional use of the shop as a café as shown in drawing numbers 4181/1 and 4181 L1 date-stamped 14th December 2007.
- The building shall be used either for permanent retail (Use Class 1) or for café purposes (Use Class 3). The café use must be taken up within 4 years of the date of this notice in order for this use to remain valid after that time.
- The café use hereby permitted shall not be open to customers outside 07.30-22.00 hours on Monday to Saturdays. The café use hereby permitted shall not be open to customers on Sundays and Bank Holidays outside 09.30-19.00 hours.
- Before the café use hereby permitted is opened for business, plans for an odour extraction system shall be submitted to and approved by the Planning Authority (in the form of a planning application), and the approved system shall be constructed and operational to the satisfaction of the Planning Authority.
