The site represents the curtilage of an existing dwelling - Mount Pleasant - and an outbuilding to the west. The site lies on the northern side of the Lhoobs Road - a minor narrow road which ultimately links The Hope with The Eairy.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as "white land" that is, not designated for development.
The following applications have been submitted in respect of this property:
and limiting the external alterations to the building, thus overcoming the reasons for refusal given previously. This proposal related to the conversion of the southern part of the building, leaving the monopitched structures at the northern end as stabling. The microfiche of this application is not of sufficient quality to print.
Proposed now is the conversion of the northernmost part of the existing barn to tourist accommodation. The changes to the building include the following:
Raising the height of the existing projecting single storey annexes and provision of pitched roofs over the existing monopitched structures
The part which is not to be converted appears in the elevations to have overhanging eaves soffits and fascias added to what is presently a more simply finished building Installation of three new windows in the northern (side) elevation and installation of two new windows in the western (rear).
A resident of Port Soderick suggests that whilst he has no objection to the proposal, it represents the creation of a new house in the countryside
Department of Transport Highways and Traffic Division raises no objection subject to adequate off street parking being provided to serve the new accommodation.
Patrick Parish Commissioners express concern that the conversion of the building could result in an adverse impact on agriculture and seek assurances that adequate barn accommodation would still be available to serve the agricultural land associated with the site.
The Isle of Man Fire and Rescue Service recommend that there is inadequate provision for a safe means of escape from the bedrooms.
The Isle of Man Water Authority recommends a note regarding water supplies to the development.
The Society for the Preservation of the Manx Countryside and Environment indicates that it has "misgivings" over the lack of information on the appearance of the property.
The scheme is different from that permitted under PA 02/0244 and as such this carries no precedent for what is now proposed. The scheme must be judged against Environment Policy 16 of the Strategic Plan which requires, inter alia, that buildings to be converted must be redundant for their original purpose, the building is substantially intact and structurally capable of renovation, is of historic, architectural or social interest and it is demonstrated that the building could accommodate the new use without requiring extension or adverse change in appearance or character.
In this case, the building, or part of the building which is to be converted has little or no interest architecturally, historically or otherwise and in any case is being changed beyond recognition in the conversion. As such, the proposal fails to accord with the provisions of Environment Policy 16. There is no information to demonstrate that the building is redundant or what is to happen to the remainder of the building.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The points raised by the Isle of Man Fire and Rescue Service are the responsibility of the Building Regulations and as such this party should not be afforded party status in this instance.
The resident of Port Soderick and The Society for the Preservation of the Manx Countryside and Environment is not directly affected by the proposal and should not be afforded party status in this instance.
The Isle of Man Water Authority raise issues associated with the provision of a water supply, which are not material planning considerations and as such the Water Authority should not be afforded party status in this instance.
In summary therefore, the following parties comply with the provisions of Planning Circular 1/06 and should be granted Interested Party Status:

R 1. The part of the building which is to be "converted" is not of any architectural, historic or social interest and as such would fail to satisfy Strategic Plan Environment Policy 16b. In any case, the proposal changes significantly the appearance of the building, thus contravening Policy 16c. Furthermore, there is no information to clarify the use of the remainder of the building to the south, which has planning permission for conversion to tourist accommodation (PA 02/0244) and how the use of this building will affect the proposed development and use of the building as is intended in this latest application including provision for car parking and amenity space.
