Department Of Local Government And The Environment ### Memorandum To: Secretary to the Planning Committee From: Miss Sarah Corlett, Planning Officer Subject: PA 07/1826 – redevelopment of site with residential development of twelve apartments, outbuilding to the rear of Farmhill Manor, Douglas Date: 19th January, 2009 ### Satisfaction Of Conditions 5 And 6 The above application was refused by the Planning Committee but approved on appeal on 8th October, 2008 subject to a number of conditions. Condition 5 states that “All works shall be carried out in accordance with an Arboricultural Method Statement supervised by a competent person. This Method Statement shall be submitted to and approved by the planning authority.” Condition 6 states “No development shall take place until samples of the facing brickwork, timber boarding, roofing, timber and galvanised metal work walkway and paving materials have been submitted to and approved by the planning authority, and these works shall be carried out in accordance with the approved details”. The applicant has provided further details of both of these elements. The Arboricultural Method Statement has been submitted and circulated to Department of Agriculture, Fisheries and Forestry and their response is attached. Doug Chalk, the Forester who was involved in the appeal and subsequent Method Statement advises that the report could serve as a model for development sites generally both in terms of how the report is set out and the methods of working it recommends. The proposal involves providing the standard protection of existing trees to be retained in terms of erecting fencing underneath the dripline, and within those areas where such an extent of protection cannot be afforded, different methods of excavation are to be employed so as to prevent destruction of the tree roots and the laying of geotextile bedding onto which surfacing will be laid avoiding deep digging. With respect to condition 6, the applicant has provided a series of photographs illustrating the decking timber, metalwork on balconies, Finn Forest Thermo Wood timber cladding, Redland Richmond slates and red brickwork as used on the Old Government Registry Office. These materials are all acceptable and complement the woodland setting. The roof tiles are not natural slate or the highest quality imitation which are slightly slimmer and more textured than those shown. However the building is not publicly visible, will be obviously new and the use of the chosen imitation slates is considered acceptable. As such, both conditions 5 and 6 are considered to be satisfied by the information submitted on 7th January, 2009 in the form of the Arboricultural Method Statement and the three pages of photographs of materials submitted on the same date.
