In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

which was considered on 15th February 2008, for the reasons set out below.

Reason(S) For Refusal:
- Whilst the site lies within an area of Residential Use on the Port Erin Local Plan, the access serving the site is so narrow and steep as not to be suitable to accommodate further traffic. Furthermore, the junction of the lane with Bradda Road is so steep as to limit its use and further traffic using this junction and lane would be detrimental to road safety and the convenience of other users of Bradda Road and the access lane.
- Due to the considerable difference in height between the site and the existing properties below - Caagher and Rocklands - a new dwelling on this site would dominate the rear private space of both of these properties and adversely affect their amenities.
- Whilst the site could accommodate a dwelling with amenity space, it is unlikely, on the basis of the plans submitted that sufficient space would be available for vehicular turning. Whilst the adjacent lane is lightly trafficked, it is narrow with limited visibility for drivers of emerging vehicles and there are other properties which use it and as such, if vehicles
visiting the site could not both enter and exit the site in a forward gear, together with there being sufficient space within the site to accommodate all vehicles associated with the sitem this will lead to problems of road safety and inconvenience to other road users.
- There are inadequate details provided to satisfy the Planning Committee that the site can be adequately drained of foul and surface water from the site.
This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
