The Site
The site represents the curtilage of the terraced dwelling 38 Patrick Street Peel. The property is situated on the west side of the street and has a rear garden which looks out towards Peel Harbour.
Planning Status
The site is located within an area identified as being 'Mixed Use' by the Peel Local Plan. The site is also within the Peel Conservation Area. Properties found within designated conservation areas are not subject to the provisions of the Permitted Development Order 2005.
The Proposal
This application seeks retrospective planning permission for the erection of a timber framed conservatory to the rear elevation of the dwelling. The conservatory is indicated as measuring approximately 4.4m by 2.56m with a maximum ridge height of 2.5m. The floor area of the conservatory is approximately 11.3sq.m.
Representations
Peel Town Commissioners recommend approval for this application. The Department of Transport Highways Division make no comment on this application. We have received no privately written representations in relation to this application.
Assessment
This development is of minor impact as it is not located on a principle elevation and cannot be easily viewed from any public vantage points. The main issues to be considered therefore are the impacts upon the existing property and impacts on any neighbouring properties.
The conservatory is of modest proportions and a design that is sympathetic to the existing dwelling. The use of materials is considered appropriate for an extension to a property of this age within an area considered to have a special character. It is considered that the conservatory is an enhancement to the rear elevation of the property.
In terms of impacts upon neighbouring properties, high boundary walls prevent overlooking whilst the scale of the conservatory is not such as to be overbearing. One aspect of concern relates to a window in the projecting gable of the neighbouring property of 40 Patrick Street (see submitted photograph) which looks out onto the rear flat-roofed extension of the proposal property. However the views from this window towards the conservatory are oblique as opposed to direct and are not considered to be sufficient to warrant refusal.
Recommendation
It is recommended that this application is permitted.
