In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr G E Gelling Proposal: Retention of a garage and extension to residential curtilage at: Cummal Beg Barroose Lane Baldrine Isle Of Man IM4 6AN
which was considered on 26th October 2007, for the reasons set out below. Date of Issue: 31st October 2007 Murray House Mount Havelock Douglas
Reasons For Refusal:
- The development and change of use proposed by the planning application is deemed unacceptable by reason that:
a) the size and location of the proposed garage will be visually detrimental within the area. As such the proposal is contrary to the provisions of policy L/RES/PR/1 of the Laxey and Lonan Area Plan Order 2005 and General Policy 3, Environment Policy 1 and Environment Policy 2 of the Isle of Man Strategic Plan 2007; and b) the proposed extension of the residential curtilage represents an unwarranted domestic intrusion into the open countryside beyond the existing residential curtilage of Cummal Beg. As such the proposal is contrary to policy L/OSNC/PR/1 of the Laxey and Lonan Area Plan Order 2005 and General Policy 3 and Environment Policy 1 of the Isle of Man Strategic Plan 2007.

The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
