Dear Sir/Madam,
I refer to the recent appeal hearing in respect of the above planning application.
In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.
I am directed to advise that Mr. G. D. Cregeen, MHK, who has been appointed under article 8(6) of the above Order to act as deputy to the Minister for Infrastructure in relation to planning appeals, has considered the report, concurs generally with the appointed person's conclusions, and accepts the recommendation that the appeal should be allowed. He has therefore directed that the Planning Committee's decision to refuse permission should be reversed, and that approval should be granted, broadly in accordance with the conditions listed in paragraph 30 of the report. In so doing, the Deputy Minister has noted in particular that –
(a) the appointed person concluded that there would be only a restricted view of the building "while the high trees and roadside hedge remain along the field frontage"; in these circumstances, he has directed that there should be a condition controlling the retention of the trees and the hedge;
(b) since the only outstanding issue is the straightforward matter of the colour of the corrugated sheeting, there should be no need to require the submission of a "reserved matters" application as would be required by the conditions set out in paragraph 30 of the report; rather, he has directed that a simple condition requiring submission and approval of details of the sheeting will suffice; and that
(c) the appointed person recommended that there should be a limitation on the use of the building; he therefore supports the imposition of an appropriate condition in this respect.
