The dwelling Ballavilley, Dhoor, Ramsey, is a large two storey detached property located on the north-eastern side of the Andreas Road, and north of Ramsey.
The site has been zoned under the Isle of Man Development Plan Order 1982 as being within an area of 'woodland' not zoned for development; the site is neither within a Conservation Area nor within an area zoned as High Landscape Value or Costal Value and Scenic Significance.
Conversion and erection of extensions to existing garage with hobbies room over to provide self catering tourist accommodation - 05/01721/B โ REFUSED on the grounds:-
The proposed development to create a self catering tourist unit in this location is tantamount to the creation of new residential dwelling in the countryside. The application site, which is within an area of private woodland, is not zoned for residential development and its residential development is therefore contrary to the Isle of Man Planning Scheme (Development Plan) Order 1982 and, in particular, the provisions of Planning Circular 1/88.
Erection of detached garage with hobbies room over - 03/00298/B - APPROVED
The application proposes the alterations and erection of extensions to provide additional living accommodation.
Lezayre Parish Commissioners:-
The Plans are more extensive than the previous application PA05/01721/B, which was last refused at appeal on 12/09/06. The Commissioners feel that this application amounts to an over development of the site.
The Chief Fire Officer makes no comment on the merit of the proposed development but request that an informative note be attached to any approval decision notice.
The Authority has received no privately written representations objecting to the application.
I consider the raising of the roof of the two wings either side of the main dwelling house to create additional living accommodation to be acceptable, and in fact the inclusion of dormer windows actually improved the appearance of the property. Again the singled storey curved extension (L'Orangerie) which links the main dwelling house to the garage and store again to be acceptable. Neither proposal will be seen from the adjacent lane due to the significant boundary treatment which runs along the eastern and southern boundaries of the site.
The Commissioners comments that the proposed application is more extensive than the previous application PA05/01721/B which was refused and that this application amounts to an over development of the site, I would question. The previous application was refused on the grounds that the conversion of the existing garage and store to self catering tourist accommodation was tantamount to creating a separate dwelling and therefore against policy. This application is an extension of the existing dwelling and I therefore the two applications are completely different matters.
I do not consider the proposals to be out of keeping or against Planning Policy. The property is set within large grounds and the proposed extensions are modest in size, I therefore consider the proposal is not an overdevelopment of the site. The extension will have no adverse impact upon the residential amenity, due to the distance, boundary treatment and siting in relation to the neighbouring properties.
For these reasons the proposal would be appropriate in this location and therefore my recommendation is for an approval.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the submitted documents and drawings 1313/1, 1313/2, 31.1.07 and 32.2.07 all received on 12th July 2007.
C 3. The external finishes of the extension must match those of the existing building in all respects.
C 4. The roof(s) must be finished in dark natural slate.
N 1. The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.
