In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Hartford Homes Limited Proposal: Demolition of existing building and erection of a five storey building and basement to accommodate 14 apartments and 23 parking spaces at: Windsor House / Brobourne Promenade Port Erin Isle Of Man IM9 6LA
which was considered on 6th September 2007, for the reasons set out below.

Reason(S) For Refusal:
- Whilst the principle of the redevelopment of the site for the creation of private apartments is considered acceptable, the appearance, form and massing of the building which is proposed is considered to be out of keeping with the streets cene of the promenade and as such would harm the character and appearance of the village as viewed from prominent and important vantage points (for local people and tourists alike) to the south west and from a closer pedestrian perspective imediately around the site, particularly when viewing the side elevations. The proposal would thus not comply with Environment Policy 42 which requires that "New development in existing settlements must be designed to take account of the particular character and identity, in terms of buildings and landscape features of the immediate locality". The Committee is not satisfied that the proposal has achieved this policy objective.
- The height of the building would appear to be excessive and would have an adverse impact on the streets cene which generally has a gradually stepped ridge level as the natural ground level rises.

The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
