Permission was sought to erect signage at Fiesta Havana, 7–17 Wellington Street, Douglas, Isle of Man. The application was decided on a delegated basis and express consent was granted on 3 July 2007. The case officer recommended approval, noting that the advertisements were modest in size and that the locality is generally commercial in character. It was concluded that the continued display of the signage would not harm the visual amenities of the area. Consent was granted subject to six conditions.
Express consent was granted for the signage. The officer found the advertisements modest in size, the surrounding area commercial in character, and concluded that displaying them would not harm the visual amenities of the locality.
Condition 1
This consent relates to the continued display of advertisements as shown in drawing numbers 1 Rev A and 2 Rev A date stamped 21st May 2007 and the location plan date stamped 21st May 2007.
Condition 2
Any advertisements displayed, and any site used for the display of advertisements, shall be maintained in a clean and tidy condition to the reasonable satisfaction of the Department.
Condition 3
Any structure or hoarding erected or used principally for the purpose of displaying advertisements shall be maintained in a safe condition.
Condition 4
Where an advertisement is required under these Regulations to be removed, the removal shall be carried out to the reasonable satisfaction of the Department.
Condition 5
No advertisement is to be displayed without permission of the owner of the site or any other person with an interest in the site entitled to grant permission.
Condition 6
No advertisement shall be sited or displayed so as to obscure, or hinder the ready interpretation of any traffic sign, railway or tramway signal or aid to navigation by water or air, or so as to render hazardous the use of any highway, railway, tramway, harbour or aerodrome.
