Officer's Report
The Site
The site represents the curtilage of Ballakilley Farm, a substantial farmhouse with a courtyard of agricultural buildings situated to the north of Rushen Primary School and just to the south east of Rushen Parish Church.
Planning Status
The site lies within an area of an Area of High Landscape or Coastal Value and Scenic Significance on the Arbory and East Rushen Local Plan.
Planning History
Planning permission has been sought for a number of developments to convert the outbuildings to residential accommodation, for a polytunnel and for alterations to the access to the site (PAs 98/1308 (refused), 97/1637 (split decision).
The Proposal
Proposed now is the creation of two new accesses, one to the south of the main entrance and one opposite Rushen Church. The accesses are modest - 3.6m openings set back from the highway by 6m to allow a vehicle to pull off the road before the gate is opened with fencing between the roadside wall and the gate.
Assessment
There is no objection from the highway authority in road safety terms and no adverse impact in visual terms.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
