The proposal sought approval in principle for a new bungalow to be built to the south west of an existing group of buildings on a field on the north western side of the B11 Ballaragh Road. The intended design was a Scandinavian log cabin construction, specifically adapted for wheelchair access, as the applicants' existing dwelling was said to be unsuitable for their needs. The officer acknowledged the applicants' significant medical difficulties but concluded that planning permission runs with the land, not with individuals, and that personal circumstances should rarely if ever justify development that would otherwise be unacceptable. Similar applications in the immediate vicinity linked to the applicants' health had also been refused. The application was refused under delegated authority in line with the officer's recommendation.
Although the applicants had significant medical needs, the officer found that personal circumstances cannot justify development that is otherwise contrary to policy. Previous comparable applications nearby had also been refused on the same basis.
