In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Infrastructure does hereby APPROVE the following application made on behalf of:

which was considered on 17th June 2011, subject to compliance with the conditions specified below.

Schedule Of Conditions:
- This approval relates to the temporary use of land for recycling for one year and subsequent restoration of site for agricultural use, Sand Pit, Lhergydhoo, German as shown by Location Plan, Site Plan and SP005 all received 20th October 2010.
- This permission shall be implemented within a period of 3 months from the date of this approval and the applicant shall notify the Department in writing within 1 month of the date of commencement.
- On, or prior to one year from the date of implementation of the permission, the Powerscreen Chieftain (or similar machinery) shall be removed from the site. Only the following may remain on site after one year from the date of the permission to assist in the restoration of the site (unless otherwise agreed in writing by the Planning Authority):
Weighbridge, (to account for all movements required by Waste Disposal License) Loading shovel and JCB 360 (to position and profile infill materials) Office cabin (for weighbridge controls and other documentation) Toilet/canteen cabin (for staff welfare)
- Within a period of three years from the date of implementation, the site shall have been fully restored to the levels provided in plan number SP005, or other such levels as may be agreed with the Planning Authority and in accordance with a restoration scheme which shall have been previously approved in writing by the Planning Authority.
- On, or prior to three years from the date of this permission, all machinery and buildings shall have been removed from the site, and the access and hardstanding shall have been removed and landscaped in accordance with a plan to be submitted to and previously approved in writing by the Planning Authority.
- The site shall only be operated between the hours of 0800 and 1700 Mondays to Saturdays. The site shall not be operated on Sundays or bank holidays. These limitations shall apply to operations on site.
- No waste shall be burned on site.
- This permission shall remain valid for a period of one year from the date of the approval and the applicant shall notify The Department of Infrastructure of the date of commencement.
- The recycling and landfill operations shall only be for inert waste from the construction industry and shall be limited to the following types of material:
soil, clay, sand, stone, brick, concrete, ceramic materials, slate, glass, and metals, all of which shall be non-leachate forming materials.
This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.
Guidance Note
This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer’s report which led to the decision, together with correspondence relative to the application, is available for inspection at the Department.
The proposed development must not be commenced until either;

- Any appeal has been determined;
Whichever is the later.
