Officer's Report
The Site
The site represents the residential curtilage of an existing property, Ballakewin Old Farm which sits on the western side of the A3 Ballamodha Road between the eastern turn-off to Silverdale and the western turn-off (B41) towards Grenaby. The site accommodates a large property with a long entrance which meets the A3 to the south of the buildings.
Planning Status
The site lies within an area designated as an Area of High Landscape or Coastal Value and Scenic Significance on the Isle of Man Planning Scheme (Development Plan) Order 1982.
Planning History
The following applications have been submitted in respect of this site:
PA 88/0675 โ approval in principle for alteration to adjoining building to convert to living accommodation - permitted
PA 89/0122 - renovation of farmhouse and conversion of adjoining barn to lounge, bedroom and en-suite bathroom - permitted PA 94/1286 - construction of dormer windows and conservatory - permitted PA 97/1215 - erection of field shelter - permitted and PA 04/0454 - installation of an additional window on south gable - permitted.
The Proposal
Proposed now is the creation of a private tennis court on land to the south of the main house. This area is presently lawned garden and screened from the main road by existing vegetation. Some excavation would be necessary - cutting and filling and the remaining earth would be re-used to form a sculptured bank on the western side of the garden, alongside the drive. Fencing almost 3m in height will contain the court and a new retaining wall at the northern end adjacent to the house.
Assessment
The tennis court will be created within an area which is already private garden and domestic in appearance and the garden area is well screened from the main road and public view. There will as such be no adverse impact from the proposed works.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the creation of a tennis court and associated works all as shown in drawing reference AT 822.1 and the site and location plans received on 29th November, 2006.
