The site represents the curtilage of the lands associated with Ballakilley, a large house with stone outbuildings all located on the eastern side of the A29 Church Road, to the north of Rushen Primary School and Four Roads. The land stretches from the Old School House in the north all the way along the eastern side of the A29 to the northern boundary with Rushen Primary School and then down to the northern side of the A5 Castletown Road, back up on the western side of the steam railway line and then back up to the A29 across open fields and alongside a stream.
The site lies within land which is covered by the Arbory and East Rushen Local Plan with the remainder, the land to the south of the existing buildings covered by the Isle of Man Planning Scheme (Development Plan) Order 1982. The land to the north including the buildings lies within an area designated on the Arbory and East Rushen Local Plan as Woodland where the buildings are situated with the land to the north designated as Open Space and an Area of High Landscape or Coastal Value and Scenic Significance. To the south the land is designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as "white land", that is, not designated for development.
The following applications have been submitted in respect of this site:
PA 91/1434 - approval in principle for renovation and conversion of outbuildings to residential units - permitted PA 93/1194 - alterations, extensions and conversion of outbuilding to guest accommodation - permitted PA 98/1308 - relocation of vehicular access and creation of new driveway - refused on appeal PA 97/1637 - enclosure of covered link to dwelling and alterations to vehicular access and creation of new driveway - split decision PA 01/1987 - approval in principle for conversion of farm buildings to 3 dwellings - permitted PA 03/1340 - conversion of redundant farm storage buildings into 3 dwellings and alteration to existing cottage - refused on appeal PA 04/0669 - conversion of redundant farm storage buildings into 3 dwellings and alteration to existing cottage - permitted PA 06/0138 - conversion of existing outbuildings to form two dwellings and amendments to vehicular access - permitted.
Proposed now is the erection of a polytunnel. This is to be erected to the south of the farm group but not far from it. The polytunnel will be 1.2m from the boundary to the north east and 600mm from that to the north east. The polytunnel itself will be 10m wide and 5m wide. The site plan submitted is prepared at a scale of 1:250 but is annotated as 1:500 (see e-mail from Mike Jackson dated 22/1/07).
The land may legitimately be used for agricultural purposes, which includes horticulture and it is equally legitimate to require buildings or structures needed in association with these uses. The polytunnel will be sited relatively close to the building group and will have no adverse visual impact.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

This permission relates to the erection of a polytunnel as shown and described in drawings reference P-01 and the details of the polytunnel. For clarification the polytunnel will be 10m by 5m in dimensions.
