The application site represents the curtilage of a residential property located to the north of Lhoobs Road, Eairy, Foxdale.
The site does not lie within an area zoned for further residential development in the 1982 Development Plan.
There have been a number of planning applications relating to the overall residential development, none of which are considered relevant to this application.
The application seeks approval in principle for the construction of a detached residential unit adjacent to the main dwelling and described as a "granny flat".
Patrick Commissioners recommend that the application be considered as a new dwelling in the countryside and the SPMCE object to the proposal. The Department of Transport Highways Division do not oppose the development subject to condition.
The application proposes, in principle, the construction of a single detached unit to be accommodated by a member of the applicant's family. Such structures, commonly described as "granny flats" or annexes, are more usually either constructed directly adjoining the main dwelling, or are conversions of existing attached garages. In this instance, the application proposes the construction of a detached unit, which, given that the building does not physically adjoining the main dwelling, may in the future be occupied by a separate household. As such, it is considered that the proposal falls to be considered as a new dwelling in the countryside, such a proposal being considered contrary to the zoning of the adopted Development Plan for the area which indicates that the site is located in an area not zoned for further residential development.
It is therefore considered that the proposal, being tantamount to the construction of a new dwelling in the countryside, is contrary to the adopted Development Plan for the area.
It is recommended that the application be refused
The local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5)(c) and (d), considered "interested persons" and as such should be afforded party status.
It is considered that all parties who submitted comments accord with the requirements of Planning Circular 1/06 and are therefore afforded interested party status.
