In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr J Smith Proposal: Removal of bridge and excavation of embankment to form new levels in association with relaying of water pipes and electricity cables at: Underpass Bridge Fox Cottage Bishopscourt Kirk Michael Isle Of Man
which was considered on 1 December 2006, for the reasons set out below.

Reasons For Refusal:
- The proposed works, by reason of its siting and design in this prominent location, would result in the removal of vegetation and part of the railway embankment within an Area of High Landscape or Coastal Value and Scenic Significance which would have a detrimental impact on the character and appearance of the area and be detrimental to the visual amenities of the locality.
Furthermore, the proposed works would introduce an alien feature within the Heritage Trail which would not respect the historic and architectural interest of the former railway line and it would detract from the attraction, interest and convenience of the footpath.
This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.
The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
