The proposal was to erect a gate at the site entrance of 4 Christian Street, Ramsey — a corner plot at the junction of Christian Street and Taubman Street used as a funeral directors. The gate would be 4.2 metres wide and up to 2 metres high, constructed from PHS vertical bars at 150-centimetre centres. However, the officer noted that under the Permitted Development (Order 2005), the applicant could erect a gate of the same width at up to 1 metre in height without any planning permission at all — and that would raise the same highway concerns. The officer also considered that the gate would typically be left open during business hours given the public-facing nature of the use, limiting congestion risk to opening and closing times only.
The application was approved because a refusal on highway safety grounds was judged unsustainable: the applicant could have erected a gate of the same width at 1 metre height without permission, creating the same congestion risk. The gate was also expected to remain open during business hours, further limiting any practical impact on traffic.

Permitted Development (Order 2005)
The Permitted Development (Order 2005) states:- *In addition, the aforementioned Order allows for the erection, construction or alteration of walls, gates and fences; outside the curtilage of a dwelling where on completion of the works;* a) *the height, as measured from ground level on either side of the fence, wall or gate, must not exceed:* - (i) *1m, where the fence, wall or gate is adjacent to a highway; or* - (ii) *2m, in any other case;*
Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.

This approval relates to the submitted documents and drawings 01439/1 and 5263/1 all received on 22nd August 2006.
