In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: J. C. K Ltd Proposal: To excavate building sand from part of field 314302 with access via concrete duct under Ballagyr Lane through existing Lhergydhoo sandpit to main A4 road at: Field 314302 (part Of), Lhergydhoo Ballagyr Lane German Isle Of Man
which was considered on 16 December 2005, for the reasons set out below.

Reasons For Refusal:
- The site it within an area of High Landscape Value and Scenic Significance; the proposed development would have an adverse impact on this Value and Significance, particularly as viewed from the Switchback Road and from Ballagyr Lane.
- The proposed development would generate heavy traffic and would result in noise, dust, and mud on the highway, all of which have an adverse effect on the amenities of nearby residents.
- There is not in the submitted application evidence to demonstrate that this proposal represents the most acceptable way of meeting the Island's continuing need for sand.
- The overhead, high-voltage electricity cables crossing the site would need diversion; this may itself require planning permission.
- This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.
