In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr & Mrs R Quayle Proposal: Conversion of existing workshop / store to self - contained flat with living accommodation at first floor level and garage at ground floor level (Re-submission of 06/00242/B) at: Workshop & Store 2 Falcon St Lane Rear Of Falcon Street Douglas Isle Of Man
which was considered on 11 December 2006, for the reasons set out below.

Reasons For Refusal:
- The proposed conversion would be contrary to the Isle of Man Planning Scheme (Development Plan) Order 1982 and, in particular, the provisions of Planning Circular 2/88, by not providing a pleasant, clear outlook, particularly from the principal room of 2 Falcon Street Lane, and does not provide any access to external space for the purpose of general amenity.
- The proposal to convert the first floor to living accommodation in this location would lead to significant overlooking from the bedroom and living room windows into neighbouring properties/rear yards, in particularly Nr 7, 9 and 11 Falcon Street. It is considered that such overlooking would detract from the residential amenity currently enjoyed by adjacent occupier and would therefore be an un-neighbourly development.
This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005
The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
