Officer's Report
The Site
The site represents the curtilage of the Southern Swimming Pool, situated within the grounds of Castle Rushen High School, to the southern side of Arbory Road.
Planning Status And Relevant Policies
The site lies within an area designated as Swimming Pool on the Castletown Local Plan adopted by Tynwald in 1991 and as Civic or other buildings, along with the school, on the draft Area Plan of 2001.
Planning History
The following applications have been submitted in respect of this site:
PA 90/4099 proposed the extension of the form manager’s officer and café area and was permitted.
The Proposal
Proposed here is the creation of a new oil tank enclosure to the side of the existing building, replacing the existing tanks which sit to the front of the building line. The fencing will be 2.5m high-higher than that allowed under the Town and Country Planning (Permitted Development) Order 2005.
Assessment
If the redundant tanks are removed after the installation of the new tank, there may be some planning gain in removing an enclosure which sits in front of the building line. Even if they are not, and any approval notice should encourage or require this, the proposal is not unacceptable.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status. despite neither party submitting views in respect of this application.
Manx Electricity Authority is a statutory authority and should be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the installation of a new oil tank and surrounding fencing as shown in drawings reference SC835/P/10-100 and -101 both received on 31st July, 2006.
C 3. If and when the existing tanks and enclosure, shown on drawing SC835/P/10-101 become redundant for their original purpose, they must be removed to the satisfaction of the Planning Authority.
N 1. The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687705) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.
The applicant is also advised to contact the M.E.A. for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
