In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr J W A Graham Proposal: Erection of an agricultural building and widening of existing farm entrance at: Field 234363 Cammall Farm Douglas Road Kirk Michael Isle Of Man IM6 1AU
which was considered on 19 June 2006, for the reasons set out below.

Reasons For Refusal:
- The proposed agricultural building would be contrary to the 1982 Development Plan Order and Policies EP8 and EP27 of the emerging Isle of Man Strategic Plan in that the proposed development is in close proximity to a watercourse and insufficient information has been submitted to demonstrate that the works will not cause any long term deterioration in water quality or provided any details on pollution and alleviation measures to protect the environment of the watercourse.
- The proposed development would be contrary to the 1982 Development Plan Order and EP18 of the emerging Isle of Man Strategic Plan by reason of its height, design, massing, layout and siting and would introduce a prominent and incongruous feature into the landscape which would cause demonstrable harm to the visual amenities of the locality.
- Insufficient detail has been submitted to demonstrate how the proposed access alteration will be undertaken and therefore the planning authority are unable to determine the impact of any such alteration.
- In light of the comments from the Department of Transport indicating that a 2m by 215 visibility splay would be required to meet the department highway standards, this would result in a substantial amount of vegetation being removed from the boundary adjacent to the A13. It is considered that such any alteration would change the character and appearance of the locality and be detrimental to the visual amenities of the locality.
This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005
The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
