This application sought approval in principle for the erection of a dwelling and garage on land to the north of Ballaleece Farm, Peel Road, St Johns, Isle of Man. The site is accessed via a track from the farm yard but sits some considerable distance from the main farm buildings. The application was refused by the Director of Planning and Building Control under delegated authority. The site lies within an Area of High Landscape Value and Scenic Significance and is outside any area zoned for residential development under the 1982 Development Plan Order, making it contrary to established countryside dwelling policies. Although information relating to agricultural need was submitted, it was not considered sufficient. The decision found that it had not been demonstrated that the proposed occupier would be engaged in agriculture on a full-time or retired basis, and the distance of the proposed dwelling from the main farm was also found to be contrary to the relevant planning requirements for countryside dwellings.
The application was refused on two grounds. First, the proposed site falls within an Area of High Landscape Value and Scenic Significance and outside any zone designated for residential development under the 1982 Development Plan Order. Second, the applicant did not demonstrate that the proposed dwelling would be occupied by someone engaged in agriculture on a full-time or retired basis, and the site was considered too far from the main farm buildings to meet the relevant countryside dwelling requirements.
