The site, defined in red, represents the curtilage of an existing property located on the southern side of the lane leading from Ballacriy Park into the new estate of housing and leisure facilities approved under 99/1432, 99/0312, 00/1438, 01/2111 and 04/2325. Part of this development is to install a lockable bollard preventing access to the estate and facilities from Ballacriy Park and requiring such access from Cronk Cullyn. The remainder of the estate is defined in blue indicating that it is within the control of the applicant.
96/0649 proposed the principle for residential development of the bungalow site and was refused on review for reasons relating to prematurity (the Arbory and East Rsuhen Plan was not adopted at that point) and part of the site was not within the area designated for development on that plan.
Proposed here is the demolition of the existing dwelling and its replacement with a new two storey structure. This will be larger than the existing and relocated further to the east into Cronk Cullyn.
There are objections from 3, 4 and 5, Ballacriy Park, in the cul de sac behind the site who are concerned at the increase in size of the property and the impact on their own property and the fact that the new house is more akin to those houses within the new estate some distance away rather than those properties close by.
The site is within the area designated on the A_ER plan as community purposes although the existing dwelling on the site would establish the residential use and presumption in favour of such use and developments. The Plan contains reference to existing property where it states "WITHIN THOSE AREAS DESIGNATED AND DEVELOPED FOR RESIDENTIAL PURPOSES, THE DEPARTMENT WILL NOT GENERALLY OPPOSE THE PRINCIPLE OF ALTERATIONS AND EXTENSIONS OF EXISTING DWELLINGS, EACH APPLICATION WILL HOWEVER BE JUDGED ON ITS OWN MERITS IN THE LIGHT OF THE APPEARANCE OF THE FINISHED BUILDING AND ITS IMPACT ON THE SURROUNDING AREA" (4.8).
The decision in respect of this application will rest therefore on the impact of the proposed replacement dwelling on the streetscape and particularly neighbours. The bollard is shown on the drawings and as such access will be via the new estate and should be dependant upon that being in place.
The existing dwelling is surrounded by bungalows and is just visible from the cul de sac on the right as one enters Ballacriy Park. Whilst it will be further away, the property will still be higher than the existing and very different from those surrounding it and, in my view, out of keeping. The other houses like it will be some distance away when built (45m).

R 1.
The proposed dwelling would change significantly the size, height and massing of the dwelling on the site, a site which has single storey properties all about it. As such, the new dwelling will be out of keeping in relation to those properties closest to it and would result in a perception of overlooking, if not actual overlooking of those single storey properties alongside.
