Department of Local Government and the Environment ### Memomandrum To: Ian McCauley, Director of Planning and Building Control From: Ian Brooks, Planning Officer 23rd July 2007 #### Compliance with Conditions – PA 05/01706 – Replacement of existing buildings with new building containing 73 apartments, 2 commercial units and basement car parking, Former Bridge Garage Site, Bridge Road and Part of Former Sawmills Site, Lake Road To consider the submission of details in accordance with Conditions 5, 9 and 10 of Planning Permission 05/01706 dated 4th September 2006. Condition 5 stated: “Insofar as this approval relates to the provision of a cycleway/walkway, it refers to only the general route (on plan) indicated on drawing number 816/master/cycle5k04/C date-stamped 3rd April 2006; the levels and details of the cycleway/walkway must be amended such that it meets the river wall at approximately courtyard level, and, therefore, continues on the bank (i.e. not cantilevered) and at, approximately, the same level as the external space around such residential buildings as may be proposed; amended drawings in accordance herewith must be submitted to and approved by the Department prior to the commencement of any works.” The applicants have submitted details. However the applicant has indicated that due to the significant difference in levels between Phase 1 and Phase 2 the cycleway/walkway must incorporate a ramps and steps in order to get from the courtyard level to riverbank level. It will then continue westwards on the riverbank and at approximately the same level as the external space around future buildings. Strictly speaking, the details submitted do not accord with the condition. However, I do consider the details to be acceptable as it will still allow access from the courtyard level to the riverbank level for all users. The applicant has confirmed that the cycleway will be on the riverbank and not cantilevered. Condition 9 stated: “Prior to the commencement of any building operations, samples/details of all external finishes must be submitted to and approved by the Department; no approval is hereby granted to any change in the external appearance of the existing riverside wall.” The applicant has submitted sample of the timber cladding and zinc roofing to be used on the approved building. The roof will have Redland Landmark Slate. The areas of render, wall hung natural slate and natural stone are as indicated on the approved drawings. I consider the details to be satisfactory. Condition 10 stated: “Prior to the commencement of any building operations, there must be submitted to and approved by the Department a detailed scheme of treatment of the external space around the building; this should include the (temporary) treatment of the space within the site but to the west of the cycleway, and should include an element of artwork, the approved scheme must be completed prior to the occupation of any of the flats” The applicant has provided details for the finishing. I consider the details to be acceptable and would not adversely affect the visual amenities of the locality. CONCLUSION I therefore recommend that conditions 5, 9, and 10 should be discharged.
