Town and Country Planning Acts, 1934 - 1991
Isle of Man Planning Scheme (Development Plan) Order 1982
Mrs Sue Cannell Ballacrebbin Bernahara Road Andreas Isle Of Man
In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr Robert & Mrs Diane Griffiths Proposal: Creation of a vehicular access and the retention of 1.5m wide pathway through a sodbank at: The Bungalow Main Road Ballaugh Isle Of Man IM7 5ED
which was considered on 4 November 2005, for the reasons set out below.
Date of Issue: 10th November, 2005 Murray House Mount Havelock Douglas
Secretary Planning Committee
Reasons For Refusal:
- The site is not designated for development or for residential use. The site is visible from the adjacent highway. The creation of a vehicular access and continued use of the pathway to the site would intensify the unauthorised use of the site as residential land and would represent an unwarranted intrusion into the countryside. The applicant has not demonstrated that there is sufficient need to justify the creation of an additional vehicular access and has not demonstrated that there is sufficient need to justify an encroachment into agricultural land.
- This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
