Officer's Report
The application seeks approval in principle for the erection of a dwelling on a parcel of land on the southern side of Clay Head Road in Lonan.
The application site has been the subject of a number of previous planning applications, most notably PA 03/00640/A which was refused and sought exactly the same as is now being sought. The Planning
Committee, following the advice of the Director of Planning, resolved to accept the planning application despite this previous refusal within five years. For the record I do not agree with decision, believing that there has not been any material change in circumstance since the last refusal.
Whilst the application site is designated for residential development within the Laxey and Lonan Plan the plan has not yet been before Tynwald and formally adopted. As highlighted by the Planning Inspector in his conclusions for the previous application it would be premature to approve the development of the site until such time that the Laxey and Lonan Plan has been formally adopted as in theory Tynwald could choose to drop the proposed residential designation of the site. Accordingly, I have to recommend that the application is refused for exactly the same reasons as previously.

Whilst the Planning Committee has considerable sympathy with the applicant in terms of the length of time taken to progress the Laxey and Lonan Plan together with the fact that the Inspector appointed to chair the public inquiry into the plan specifically recommended that the development of the site is acceptable, the fact remains that the Laxey and Lonan Plan has not yet been considered by Tynwald and as such an approval for development on the site would be judged premature until the area plan process has been exhausted.
