In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Wendy Smith Proposal: Approval in principle for the erection of a dwelling at:
- Land To The South East Of Stroule
- Clay Head Road
- Baldrine
- Lonan
which was considered on 15 July 2005, for the reasons set out below.

Reasons For Refusal:
- Whilst the Planning Committee has considerable sympathy with the applicant in terms of the length of time taken to progress the Laxey and Lonan Plan together with the fact that the Inspector appointed to chair the public inquiry into the plan specifically recommended that the development of the site is acceptable, the fact remains that the Laxey and Lonan Plan has not yet been considered by Tynwald and as such an approval for development on the site would be judged premature until the area plan process has been exhausted.
- This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.

- any review of the initial decision has been completed; or
- the time for requesting an appeal in relation to any decision at review has expired; or
- any appeal has been completed.
