Officer's Report
The application seeks approval for the construction of a replacement dwelling on a site located on Main Road in Sulby, Lezayre. The existing dwelling is one of a pair semi-detached dwellings.
It is understood that the replacement dwelling is proposed due to the building being structurally unsound. I was previously aware of this and understand that the property was originally going to be underpinned but that due to financial reasons, i.e. insurance payments, this is no longer possible. Accordingly, this planning application proposes to erect a replacement dwelling that is detached from the neighbouring property.
The proposed dwelling is traditional in its style of design and I consider it to be acceptable. The owner of the neighbouring has objected to the planning but not specified their concerns, but I would assume that they relate to the structural effect of demolition. There is no planning reason why the dwelling could not be demolished and I would suggest that the method of demolition is a building control matter. Lezayre Parish Commissioners have no objection to the planning application. SPMCE have objected on the grounds that they consider the replacement unnecessary, from which I assume that they do not know the reasoning behind the application. The Department of Transport Highways Division have objected to the planning application on the grounds that they consider there to be insufficient details of the access arrangements. I would suggest that the application is sufficiently detailed and that the proposed arrangements are an improvement on the existing ones, so that what is proposed is the best that can be realistically achieved on the site. The applicant’s agent has submitted details of what will happen with the cable end of the neighbouring property. These details, which I assume will require the agreement of the neighbour, seem acceptable.
I recommend that the planning application be approved.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to drawing no.s 5122/1/1, 5122/1/3, 5122/1/4, 5122/1/5 and 5122/1/6 date stamped the 21st July 2005.
C 3.
The development must be connected to the public foul sewer in a manner acceptable to the Department of Transport Drainage Division.
C 4. There must be no discharge of surface water (including that from roofs and paved areas) from the development to any foul drainage system(s).
C 6. The exposed gable wall of the neighbouring property must be made good with render within six months of the demolition of the adjoining property.
