This application has been recommended for approval for the following reason.
The proposed development is not likely to harm the character and appearance of the area or the amenity of neighbours and therefore complies with the General Policy 2 of the Isle of Man Strategic Plan 2016. For these reasons, the proposal is acceptable and recommended for approval.

Officer’s Report THE SITE
1.1 The application site is the residential curtilage of No. 7 Ballacriy Park, Colby, a detached bungalow located on a corner plot with a larger residential estate. The existing dwelling benefits from an extension and an attached double garage to the south elevation. THE PROPOSAL - 2.1 The proposal seeks approval for the installation new uPVC white framed window to the side elevation (western). The window will measure 1000mm x 889mm. This window would be installed on the same horizontal level as the existing side window and finished in white as existing. PLANNING POLICY - 3.1 The application site lies within an area zoned as 'Predominantly Residential' under the Area Plan for the South 2013. In terms of policy it is important to consider General Policy 2 and paragraph 8.12.1 of the Isle of Man Strategic Plan 2016 in the assessment of this application, as well as section 3.2 of the Residential Design Guide 2019 (RDG) which refers to extensions to existing dwellings and roof design:

"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
4.1 PA 05/00443/B - Demolition of existing garage and erection of garage to east boundary, erection of sun lounge extension to south elevation, installation of uPVC windows and doors to replace existing and painted dash and render over existing brickwork - Permitted (04.05.2005)
4.2 PA 05/01531/B - Erection of an extension to provide dining room and attached double garage to south elevation, removal of two windows to east elevation and replace with one uPVC window and alterations to vehicular access - Permitted (10.09.2005)

5.1 (DOI) Highways Division confirms that there is no highways interest. (03.08.21)
5.2 Arbory and Rushen Parish Commissioners considered the application and are in support. (24.07.21) ASSESSMENT - 6.1 The fundamental issues to consider in the assessment of this planning application are; (i) the impact of the proposed development on the character and appearance of the existing dwelling, (ii) the impact of the proposal on the surrounding area and street scene.
6.2 The proposed works would not be fully visible from any public vantage point as they are to the side elevation of the property and the works are obscured by the boundary fencing. As
the proposed works are to be carried out at ground level there would be no aspect of overlooking towards any of the neighbouring properties and the outlook from the new window would be no worse than the views from the existing adjacent window.
6.3 With regard to the impact of the new window on the appearance of the dwelling or living conditions of neighbouring properties, it should be noted that its impact will be negligible. The proposed window will increase lighting to the inside of the dwelling and as such improve the functionality of the space as well as its appearance. This window will not introduce any privacy concerns as it is screened by a 1.8m fence. CONCLUSION - 7.1 In summary, the proposed development is not likely to harm the character and appearance of the area or the amenity of neighbours and therefore comply with the aforementioned policies in the Isle of Man Strategic Plan 2016. For these reasons, the proposal is acceptable and recommended for approval.
