Refusal Notices 04/02473/A
Town and Country Planning Acts, 1934 - 1991
Isle of Man Planning Scheme (Development Plan) Order 1982
E B Holdings Ltd White Hoe Garage Old Castletown Road Douglas IM2 1QD
In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: E B Holdings Ltd Proposal: Approval in principle for the erection of light industrial units at: Land Adjacent To E B Christians & White Hoe Industrial Estate Old Castletown Road Douglas
which was considered on 29 April 2005, for the reasons set out below.
Date of Issue: 16th May, 2005
Murray House Mount Havelock Douglas Secretary Planning Committee
Reasons For Refusal:
- The land is not zoned for industrial use on the Douglas Local Plan, but is zoned as part of an area of Open Space or Woodland; the proposed development would thus be contrary to the Local Plan; the evidence to support the making of an exception to the Plan is insufficient to outweigh the visual detriment arising from the introduction of light industrial built development on this green space at the edge of the town.
NOTE The Planning Committee judges that the proper opportunity for considering the future use of this site and the provision of additional land for industrial use in the Douglas area is the formulation of a new Area Plan for the east of the Island.
NOTE This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.
Note 1: The decision contained in this notice does not become final until:-
- the time for requesting an appeal in relation to any decision at review has expired; or
- any appeal has been completed.
Note 2: Rights of appeal against the decision of the planning committee are attached.
Note 3: An appeal may be requested within a period of 21 days.
