The site represents a part of an existing industrial building situated within Ronaldsway Industrial Estate locate the kind of Strix and close to the steam railway line.
Proposed is the conversion of the existing office to a nursery and family centre to be run by Manx Family Services Ltd. There would be 3 full time staff within the nursery, 5 full-time staff with in the family centre. The number of children to be accommodated in the nursery is 18 and fifteen car parking spaces are available on site.
Previously the applicant sought approval for the conversion of an existing property at 2, The Promenade in Castletown to a day nursery and family centre. This was refused initially, at Review and appeal for reasons relating to parking although residents raised issues of noise, disturbance and provisions for disabled clients as well as traffic all of which were cited by the Inspector as reasons for refusal. This would suggest that other than a detached house with plenty of parking space available to it, a residential area may not be ideal for this type of operation due to its scale and level of activity.
As such, this is why the applicant has looked outside residential areas in order to find somewhere with sufficient parking and which would not adversely affect the amenities of nearby land users. In this instance there have been no objections from neighbours - the only objectors being the local Commissioners with whom the applicant has met and explained the background to the project and whilst sympathetic, the Commissioners wish to adhere to their initial objection on the basis of land use designation.
This is an unusual use of land which cannot easily fit into a defined land use category. The nursery side is well sited for those travelling from the south to Douglas with safe and convenient access off the principal traffic route. A minibus service will be operated for those parents who cannot come to the site by car although the public bus service runs past the site with only a short walk to the building from the A5.
Whilst this is not an industrial use in such an area, I consider that the alternative locations for this facility, which is much needed in the south, are so limited as to warrant approval, particularly as the use will not have any adverse impact on adjacent land users.

C 1.
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the conversion of the premises to a nursery and family centre with extension and erection of fencing all as shown in drawings K012/P/10-01, K012/P/12-02 and K012/P/10-03 all received on 28th September, 2004.
C 3. The building and associated site may be used only as a day nursery and offices and facilities for the support of families and the administration of these facilities.
N 4. The applicant should consult the Fire Safety Department with respect to the fire precautions required in the new premises.
N 5. The building should be fully usable by unassisted wheelchair users: exits, particularly for emergency evacuation should be accessible thereby and clear marking of such exits provided. Emergency exits should lead onto pathways which provide an accessible route away from the building. A lift should also be provided to allow an unassisted wheelchair user to access the upper floor.
