The site represents a building which is part of a complex of farm buildings, catteries, kennels, tourist accommodation and camping facilities all of which have been approved incrementally since the late 1980s. Since then the owner has sold off parts of the complex although the blus area associated with this application includes a fair size of agricultural land (22ha/54 acres).
The building which is the subject of this application was approved as a facilities block for the camp site. Conversion was approved to living accommodation in 1994 under PA 94/1029 for accommodation for an agricultural worker, someone who was working or retired from working on the farm or a retired agricultural worker. Since then we have granted approval for a new agricultural building and a new cattery(01/2683).
The reasons given for the proposed removal of the occupancy condition is given as relating only to the standard agricultural worker's condition, not the wording which was clearly specifically written for this situation. The applicant states that she wishes to plan for her family's future and indicates that her
involvement in the cattery business will only carry on for a limited time. Presumably she could then retire to the house in question or the new cattery owners could live there.
No indication is given of any marketing of the property or the amount of accommodation already on the site and who occupies this.
I do not feel that there is sufficient information in the application to warrant removal of this tie. It may be appropriate to consider amending the condition to include those working on the site in the form of the cattery/kennels/pet cemetery/camp site etc if this is not felt to be catered for in the existing wording.

The Planning Committee is not persuaded that there has been any change in circumstances which warrant the removal of the occupancy tie which was specifically worded to cater for this site in 1994 (PA 94/1029). The site still accommodates around 54 acres of land and a complex of businesses including a camp site, cattery and pet cemetery. No indication is given in the application of who else lives on the holding and the role they play in the running of these businesses and whether accommodation would be required for this. Finally, no effort would seem to have been made to market the property with the ties applied and as such the Planning Committee cannot be sure that there is no requirement for the property as restricted.
