Re: CRONK DHOO, GREEBA, GERMAN.
Application for the lifting of Planning Conditions No.5, a) b) c) imposed by Planning Application No. 94/1029 approved 24th March 1995.
The conditions presently restrict the use of the property to persons employed or previously employed and their dependants in Agriculture. I wish to apply to have them removed as it is my contention that the Conditions, due to changing circumstances have outlived the purpose for which the y would have been imposed.
Conditions in agriculture have changed to such an extent since, that in our circumstances, they are now out of date and unworkable.
Additionally the conditions were originally imposed upon what was a Barn conversion and I believe that it was not normal Planning practice for conditions of occupancy to be applied to such an Approval.
History
The dwelling that is the subject of the Application was originally a redundant farm Barn that was approved by the Application No.94/1029 for conversion into what is now my home.
The conditions which I am requesting to be removed were imposed by 94/1029. In reflection I should have challenged them at the time as the Smallholding was barely providing any income from the agricultural activities and I was diversifying at that time in order to provide income. I was unaware of their consequences, and could not foresee the changes in Agricultural viability that I feel have since made the conditions out of date.
Agriculture has changed considerably since 1994, returns have fallen dramatically and have made it impossible for me to get any reasonable income from my land. My Partner who used to work part-time on Cronk Dhoo has had to go into full-time work.
My Smallholding is only 50 acres set on sloping land at the foot of Greeba Mountain, of which 18 acres are unusable being very steep and rocky and the remainder only suitable for sheep grazing. This brings me no return at all against the costs of running them and therefore I have now let the grazing to a Shepherd who runs sheep elsewhere also. This appears to be a common situation now as I know of other such Farmers who run sheep on a number of other Farms, (some much larger than mine) in order to provide a living With costs rising and returns only likely to diminish, I expect that other Smallholdings and
Farms will also face the same situation as we do. In essence the property is no longer viable as a Farm in any sense.
The Department of Agriculture have indicated that they are of this opinion and Mr. Peck the Agricultural Advisor has indicated he will confirm this.
I have attempted to diversify by developing the Dog Kennels and Cattery and the Camping Site at Cronk Dhoo, but this has only provided income to help the place keep going along with my Partner's income.
The Conditions imposed relate to the occupancy of our home being confined to :-
a) Agricultural workers and dependants b) Retired Agricultural workers and dependants c) Persons actually employed on or retired from employment at Cronk Dhoo Farm.
I contend that these conditions imposed are not relevant now due to :-
condition a) Changes in agriculture are such that the agriculture worker referred to is very rare indeed and our property would not be suitable to rent to as our large family home would be outside their resources. From my knowledge of the few who still are employed, they are part of the normal housing market, living where they desire as mobility now allows them such choice where as previously they were tied to where they worked. Many agricultural workers now run contracting business's working wherever they get jobs and thus need not reside in the country.
condition b) Retired agricultural workers - to my knowledge retired agricultural workers if they stay in the countryside, are likely to live on the Farm they worked on. otherwise, I believe that they enter the normal housing market. Cronk Dhoo is a family home with attached land and is unlikely to be a suitable retirement property for such retired persons.
condition c) As we have indicated before, Cronk Dhoo cannot provide an income from agriculture for us and anybody else who would purchase it. Looking at our future, we may not anyhow retire at Cronk Dhoo.
I am making the application as I am at the stage where I wish to plan for my family's future. The Smallholding as previously stated, is not economically viable and whilst I run the Camp Site and Kennels and Cattery I can only carry on for limited time.
My only daughter is very is most unlikely to take on any of our activities as she intends to get higher education and a career elsewhere and if the Camp Site, Kennels and Cattery continue to be operated it is most likely to be someone who has no agricultural tie.
Therefore it is my contention that big changes of circumstances have occurred since the original application, the conditions imposed then were marginal and are now unworkable and I request that they are removed.
In looking at the situation in agriculture where change has been so dramatic, it would appear to me that the traditional farming has changed considerably. The small Manx Farm (in the current economic situation of almost full employment and high wages) has become no longer viable to run in the traditional manner.
Farms are combining or being run by Tenants who may own another Farm and rent other land also.
The traditional Farm Labourer is now rare, with Agricultural Contractors replacing their role. This leaves a surplus of Farmhouses, and agriculture is becoming like other businesses where it is not necessary to live on site.
Many Farm dwellings having been in existence prior to Planning and are not tied by any Planning Conditions and can be part of the normal housing market. Our situation is an anomaly whilst not now being not required in Agricultural terms, but not free to be part of the normal market due to the planning conditions imposed.
We ask that on this evidence you give favourable consideration to our application
