In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr M J Pinson Proposal: Approval in principle for the creation of plots for two dwellings on site to rear and side of Palm Cottage, Croit Greanagh and at: Ashbourne House Ballacraine St. Johns Douglas IM4 3NF
which was considered on 4 November 2004, for the reasons set out below.

REASONS FOR REFUSAL:
- The development of the site for two building plots as proposed would constitute undesirable backland development in that it would:
(a) Due to its elevated position, overlook and dominate both the existing properties to the south of the site, adjacent to the highway as well as existing garden areas of properties to the west.
(b) Be served by a narrow and inappropriate access road; the use of which by vehicles would seriously harm the amenities of adjacent properties particularly those on either side of the access; and

(c) Harm the appearance of the site in its wider setting of terraced housing on the road frontage with open farm land behind; this would be detrimental to the rural character of St Johns.
- This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.
