Officer's Report
The site consists of a dwelling and antique shop on the Main Road, in the centre of the village.
Approval in principle is sought for the conversion of the premises from a shop to a restaurant/takeaway. It is assumed that it will be a Chinese given the name of the applicant. It is not clear whether the residential element of the existing premises will change.
No details of any extraction system have been provided which is a significant omission considering the proximity to neighbouring residential properties.

The Highways Division has objected because there is no legal parking close to the application site and the use will generate illegal parking.
The Commissioners have no objection in principle but are concerned about rubbish, litter, noise, smell etc. and the disturbance to local residents.

The uses of the premises would generate additional traffic which would be likely to cause congestion on the Main Road. The use and its associated smells would be a nuisance to the neighbours on either side of the premises and there is in any case no indication of where the extraction flue would be positioned. If it were on the side elevation it would detract from the appearance of the area. Takeaway use has been refused at Appeal on this site in 1986 due to the impact on the adjoining residents.

R 1. There is in the application insufficient information to allow a proper assessment of the air extraction system that would inevitably be required in association with the proposed restaurant/takeaway use. In so far as it has been possible to assess the proposed use, it has been judged that that it would create noise, disturbance and smells which would have a harmful effect on the amenity of nearby residents.
R 2. Notwithstanding the above, there are limited opportunities for on street parking along the Main Road which is a particularly narrow stretch of the A3 highway through Kirk Michael Village. The use and
in particular the takeaway use would lead to an increase in on street parking including illegal parking which would be contrary to the interests of road safety.
