Delegated Approval Decision Notice
The level of the noise emitted from the extract system shall not exceed typical background noise levels of LAeq, 5 minute - 40 dB daytime (0700 - 2300) and LAeq, 5 minute - 30 dB night time (2300 - 0700). This shall be measured at the boundary of residential premises or 1m from the façade of any residential premises, whichever is closer to the extract system. Also, there shall be no annoying and audible impulsive or tonal noise from the extract system as measured at the same location.
C 2. The takeaway must not be open later than 11 p.m. on any night.
C 3. The extracted air shall be discharged not less than 1 m above the roof eaves of the building housing the commercial kitchen. Additional control measures shall be incorporated to prevent any adverse impact of odour to local residents such as either:
i) Fine filtration or ESP following by carbon filtration (carbon filters rated with at least 0.1 second residence time).
ii) Fine filtration followed by counteractant/neutralising system to achieve the same level of control as (i) above.
C 4. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
I confirm that this decision accords with Government Circular No 57/01 (Delegation of Functions to Director of Planning and Building Control).
