ON APPEAL: Planning Application No: 04/00426/B – P. & A. Letch – Removal of agricultural workers tie on existing dwelling, Ballavarkish Beg, Grenaby Road, Ballabeg
I refer to the recent appeal hearing in respect of the above planning application.
In accordance with the provisions of paragraph 7(5) of Schedule 1 to the Isle of Man Planning Scheme (Development Plan) Order 1982, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.
I am directed to advise you that the Minister, having considered the report, has agreed to accept the recommendation of the appointed person. Accordingly, he has directed that the appeal be dismissed and that the decision of the Planning Committee to refuse the application be confirmed.
Additionally, the Minister has noted that the appellants are, apparently, occupying the dwelling in question, even though they were aware, when purchasing the property, that it may be occupied only by an agricultural worker. In these circumstances, the Minister has directed that, within three months of the date of this letter, the appellants should submit to the Planning Committee for consideration proposals for the future occupation of the dwelling which do not involve a breach of planning control. Whilst the Minister understands the personal difficulties to which this matter may give rise, he must nevertheless advise that, in the event of it not being concluded satisfactorily, consideration will be given to legal action in respect of offence in terms of articles 4 and 21 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
