Dear Sir/Madam, ON APPEAL: 04/0281/B – Mrs Linda Kermode – Amendments to approved cattery building (01/2682B) at Cronkdhoo Farm, Main Road, Greeba, Douglas. I refer to the recent appeal hearing in respect of the above planning application.

In accordance with the provisions of paragraph 7(5) of Schedule 1 to the Isle of Man Planning Scheme (Development Plan) Order 1982, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.

I am directed to advise you that the Minister has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly he has directed that the Planning Committee's decision to refuse permission should be confirmed.

Additionally the Minister has noted that some of the works have already been undertaken without permission. In these circumstances, he has directed that

(a) within twenty-eight days of the date of this letter, there must be submitted to the Planning Committee for approval a scheme detailing how the unauthorised works are to be removed; the scheme must include a programme detailing when each stage of the works is to be undertaken; and

(b) within six months of the above scheme being approved by the Committee, the scheme must be implemented in full.

Failure to comply with this direction will result in the matter being referred to H.M. Attorney General for consideration of legal proceedings in respect of an offence in Terms of articles 4 and 21 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
