The application seeks approval in principle for the creation of a new farm dwelling and associated agricultural outbuildings on land in Andreas.
It is understood that the applicant currently lives at West Craig Farm with his father. His father retired some years ago and the applicant now runs the farm. The applicant considers that the existing West Craig site is too small and has inadequate space for expansion.
Based on information provided by the Chief Agricultural Officer I understand that the farm holding comprises of approximately 300 acres, of which 30 acres are owned and the remainder leased. The Chief Agricultural Officer has also advised that, in their opinion, there is sufficient agricultural need for the new dwelling and the buildings. However, I consider that granting approval would be tantamount to the creation of a new dwelling in the countryside, as it would result in the same farm holding having two separate farms. This coupled with the situation regarding land ownership and leased land means that the new dwelling is insufficiently justified to override the normal presumption against new residential development in the countryside.
However, I do accept that the existing situation with West Craig Farm limits the effectiveness of the farm to a certain degree. It appears to me that the applicant should either concentrate their efforts on expanding the existing West Craig Farm, which I do not consider to have been fully explored. The only other option would be to grant approval subject to some form of legal agreement that required the demolition of the existing West Craig Farm following the construction of the proposed one. I do not know whether the applicant would be willing to enter into such a legal agreement and, more importantly, I do believe that such a legal agreement would be appropriate given the land ownership issue.
Aside from the issue of need an objection from the Department of Transport Highways Division regarding visibility has been partially resolved by the submission of amended drawings that show that the requisite visibility splays could be accommodated within the confines of the applicant's land ownership. Therefore I suggest that if approval in principle were to be granted it should be subject to a condition requiring the submission of further details of the proposed visibility splays.
In conclusion I recommend that the application be refused.

R 1. The applicant's level of land ownership and the circumstances regarding their leased land is considered to be insufficient to justify the construction of a second dwelling within the farm holding. As such the proposal is viewed as being contrary to Planning Circular 3/88 regarding new agricultural dwellings and the presumption against new residential development prevails.
