In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the application made by you on behalf of:
Ballacutchel Farms Ltd Proposal: Erection of a farm dwelling, agricultural shed and access road to replace former dwelling and outbuildings at: Bwoailliecowle Starvey Road Peel which was considered on 30 April 2004, for the reasons set out in the attached schedule. Reasons For Refusal
Application Ref No: 03/01318/B On Review
- The erection of a farm manager's dwelling and agricultural shed would be inappropriate in this attractive rural area which is valued as having High Landscape Value and Scenic Significance for the reasons that:
a. the site is valued as having ecological and wildlife importance which would be harmed as a result of the development. b. the size and siting of the house would have a detrimental impact on the character and appearance of the area as seen from the highway and public right of way.
- Whilst the Planning Committee accepts that the applicant is heavily involved in farming, it is not persuaded that the applicant could fully comply with an agricultural occupancy condition as defined in Planning Circular 3/88.
NOTE The applicant is advised to discuss the re-siting of the agricultural building and the potential for a new dwelling associated with this land with the Planning Officer.
