In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the application made on behalf of:
Mr Declan Jackson
Proposal: Erection of dwelling and garage at: Plot 134 Fairways Drive Mount Murray Braddan
which was considered on 8 August 2003, for the reasons set out in the attached schedule.

REASONS FOR REFUSAL
Application Ref No: 03/00120/B
- The garage shown in the drawing reference 03/677/5 received on 23rd June 2003 and which has already been erected, is taller than both that which was approved under PA01/1928 and the existing garage on plot 135. The additional height and bulk at the upper level which effectively looks like another house squeezed in between the dwelling which would be built on plot 134 and the garage on plot 135 and represents overdevelopment of this plot, as viewed both from Fairways Drive and the Castletown Road.
- Whilst the dwelling proposed in the application would be acceptable if situated alongside the garage which was approved under PA 01/1928, the impact of the dwelling alongside the garage which has been built would represent overdevelopment of the plot and a mass and bulk of development exceeding those of adjacent plots.
NOTE As the garage has already been erected without permission and permission has been denied, the building must be either removed or modified so as to be in compliance with PA 01/1928 within 3 months of the date of this notice becoming final.
NOTE This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
