This application sought to vary a condition attached to an earlier planning permission (reference 20/00323/B) for land at Ballafletcher Road, Cronkbourne, Douglas. The specific change was to alter the approved colours of the materials used for the roof, walls, and doors of the development. The site is a vacant, scrubland plot to the north of Ballafletcher Road, bordered by sports pitches to the north and west and an existing industrial estate to the east. Access is taken from the Ballafletcher Estate Road, with a field gate onto Ballafletcher Road. The application was submitted by the Department of Infrastructure and was approved by delegated decision on 19 May 2021, subject to ten conditions.
The Department of Environment, Food and Agriculture approved this variation to an existing planning permission. The change allowed the colours of the roof, walls, and doors to be altered from those originally specified in the earlier consent.
General Policy 2 of the Strategic Plan

General Policy 2: Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption. 6.3 Development outside of areas zoned for development

Condition 1
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Condition 2
Prior to the development hereby approved being completed and brought into use, a Stage 2 Road Safety Audit shall be submitted to and approved in writing by the Department. The development shall take place in accordance with the approved details and be retained as such thereafter.
Condition 3
The development hereby approved shall not be brought into use until the vehicle manoeuvring, parking and pedestrian areas have been laid out in accordance with the drawings number 19/2766/06D (Proposed Site Plan submitted under 20/00323/B - date stamped as having been received 02.06.20) and those areas shall be retained as such thereafter.
Condition 4
The finishes and colours of the building hereby approved shall be in accordance with the detail shown on drawing number 19/2766/05E (Proposed Elevations and Section) date stamped as having been received 30.03.21.
Condition 5
Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2012, or any order which amends or supersedes it, no gates, walls or fencing may be erected on the site other than in the locations and in accordance with the details as shown on drawings number 19/2766/06D submitted with 20/00323/B (Proposed Site Plan - date stamped as having been received 02.06.20) and 19/2766/05D (Proposed Elevations and Section - date stamped as having been received 16.03.20).
Condition 7
No importation to the site of inert materials or soils for infilling or landforming shall take place until a scheme for assuring the physical and chemical suitability (including freedom from potential land contaminants) of all soils and materials to be imported has been submitted to the Department and such a scheme has been approved by the Department. The scheme as approved in accordance with the condition shall be adhered to with respect to all inert material and soil importation associated with the development hereby approved.
Condition 8
The crashed vehicle compound and forensic inspection area shall be of impermeable construction with an oil interceptor installed to prevent any oils escaping from the site and entering the surface water drainage system.
Condition 9
There shall be no external storage on the site of damaged vehicles other than within the crashed vehicle compound as shown on drawing number 19/2766/06D(Site Plan) - date stamped as having been received 02.06.20 submitted with 20/00323/B.
Condition 10
There shall be no office use within the site other than as shown on drawings numbered 19/2766/03C (Ground Floor Plan) and 19/2766/04D (First Floor Plan) - both date stamped as having been received 16.03.20 as submitted with 20/00323/B, and no office use shall occur other than that which is ancillary to the use of the site as a site for vehicle and driver testing.
Condition 11
The development hereby approved shall not be occupied unless it has been carried out in complete accordance with the approved finished floor and ground levels as shown on the approved plans under 20/00323/B.
